Privacy Policy of ubibot.pl

1. Who controls your data

The controller of personal data collected on ubibot.pl is Tomasz Trocki, trading as OMNIC Tomasz Trocki, ul. Czerwona Droga 26, 02-496 Warsaw, Poland, VAT number (NIP) PL1130780422, REGON 012977790 (Omnic). We are the authorised UbiBot distributor in Poland. For any data protection matter, write to [email protected] or call +48 602 288 737.

2. What data we collect and why

• Contact form and quote request: name, e-mail address, phone number, company tax ID and your message. We use them to answer your question and prepare a quote. Legal basis: steps taken at your request before entering into a contract (Art. 6(1)(b) GDPR), and for questions not related to a purchase, our legitimate interest in answering correspondence (Art. 6(1)(f) GDPR).
• E-mail and phone: data you give us when you write or call is used for the same purposes and on the same legal bases.
• Sales and delivery: if you place an order, we process the data needed to perform the contract, issue an invoice and ship the goods (Art. 6(1)(b) GDPR). We keep invoices and accounting records because tax law requires it (Art. 6(1)(c) GDPR).
• Legal claims: in case of a dispute, we use the data on the basis of our legitimate interest in establishing, exercising or defending claims (Art. 6(1)(f) GDPR).
• Website operation and security: the server and the Cloudflare service record technical data such as IP address, browser type and time of visit, so that the site works and is protected against attacks (Art. 6(1)(f) GDPR).
• Visit statistics: Google Analytics collects data on how you use the site only after you consent in the cookie banner (Art. 6(1)(a) GDPR). We do not link this data with Google Ads and do not use it for advertising.

Providing data is voluntary. Without an e-mail address or phone number we cannot answer your enquiry, and without invoice and delivery details we cannot fulfil your order.

3. Who receives your data

We entrust data only to companies that help us run the website and our sales:

• dHosting (website server and e-mail);
• Cloudflare (website delivery and protection against attacks);
• Google Ireland Limited (Google Analytics, only with your consent);
• wFirma (quotes and invoices);
• courier companies, when we ship goods;
• the bank, when you pay by bank transfer.

We do not sell your data. We do not pass it to the UbiBot manufacturer or to anyone else for marketing purposes.

4. Transfers outside the European Economic Area

Google and Cloudflare may also process data in the USA. This is done on the basis of the European Commission adequacy decision (EU-US Data Privacy Framework) or standard contractual clauses.

5. How long we keep your data

• Enquiries and correspondence that did not lead to a purchase: up to 2 years from the last contact.
• Contract data: until claims become time-barred.
• Invoices and accounting records: 5 years from the end of the year in which the tax payment deadline passed.
• Statistical data in Google Analytics: no longer than 14 months.
• Once you withdraw consent, we stop collecting statistical data.

6. Cookies

The site stores the following in your browser:

• essential cookies needed for the site to work: the website session (EBSSID), your choice in the cookie banner (EBCookies, 12 months) and Cloudflare cookies that protect the site against attacks;
• statistics cookies of Google Analytics (_ga, _ga_*, up to 2 years), stored only after you click "Accept".

You can change your choice at any time with the "Cookie settings" link in the page footer or by deleting cookies in your browser. Rejecting cookies does not affect how the site works.

7. Your rights

You have the right to:

• access your data and receive a copy of it;
• rectify your data;
• have your data erased;
• restrict processing;
• data portability;
• object to processing based on our legitimate interest;
• withdraw your consent at any time, without affecting the lawfulness of processing before the withdrawal.

To exercise these rights, write to [email protected]. You also have the right to lodge a complaint with the Polish supervisory authority, the President of the Personal Data Protection Office (Prezes UODO, ul. Stawki 2, 00-193 Warsaw), or with the data protection authority in your own EU country. We do not make automated decisions and do not profile users.

8. UbiBot app and cloud

You create an account in the UbiBot Connect app and on the UbiBot platform (console.ubibot.com) with the device manufacturer. Account data and device readings are processed by the manufacturer as a separate controller, under its own privacy policy: ubibot.com/privacy. Omnic has no access to your account unless you share a device with us yourself, for example for technical support.
